No. In New Jersey you can’t legally grow cannabis at home, even though buying and using it is legal for adults 21 and older. The state’s Cannabis Regulatory Commission (NJ-CRC) puts it plainly: current law “does not give authority to NJ-CRC to authorize private, residential, or any growing of cannabis outside of a business with a cultivation license.” That answer has no exception for medical patients. Here is what the law does let you do, in plain terms, and where the cannabis on a licensed shelf comes from.

Why buying is legal but growing isn’t
New Jersey legalized adult-use cannabis through the CREAMM Act, which set up a licensed market: cultivators grow, manufacturers make products, and dispensaries sell them, each under a state license. Home growing was left out of that law, and the CRC says it has no authority to allow it. So the plant in a pot on your windowsill is not legal here, even though the jar you bought down the road is.
What you can do instead
Buy from a licensed dispensary
Anyone 21 or older, New Jersey resident or visitor, can buy at a licensed dispensary with a government ID. Each purchase can include up to the equivalent of one ounce: 28.35 grams of flower, 4 grams of concentrate or vape oil, or 1,000 mg of edibles (ten 100 mg packages). Mixing types counts toward that one limit, so half an ounce of flower plus 2 grams of concentrate is a full order. Purchases also carry New Jersey sales tax and other charges set by law; your receipt itemizes them.
Keep what you buy
Adults 21 and older can have up to 6 ounces of cannabis and cannabis products in their possession. Use it in private spaces; landlords can say no on their property, and hotels set their own rules.
Share it, but don’t sell it
You can give up to one ounce to another adult 21 or older as a gift. You can’t take money or anything else in return.
Where licensed cannabis comes from
Since home grow is off the table, every legal gram in New Jersey comes from a licensed business. Every flower jar on the Red Oak shelf was grown in New Jersey by a licensed cultivator. Our flower page lists the eighths, smalls and popcorn buds on the menu now and the brands behind them. Our house brand, Red Oak Cannabis, is made right here at 401 White Horse Pike in Absecon under New Jersey manufacturer license M000273, in the same building as the store. Pre-rolled options are on our pre-rolls page.
A few rules that trip people up
- Driving: driving while impaired by cannabis is against the law, the same as with alcohol. Keep purchases sealed on the way home.
- State lines: taking cannabis out of New Jersey is illegal, so it stays here.
- Public places: the CRC says cannabis smoking is allowed only where cigarette smoking is permitted, unless a place says otherwise, and public beaches, parks, boardwalks and casino floors are off limits. Our guide to cannabis rules in Atlantic City covers the shore specifics.
